These Terms & Conditions (“Terms”) govern your use of believeinsantamonica.com (the “Site”) and the email and text message programs operated by Believe in Santa Monica (“Believe in Santa Monica,” “we,” “us,” or “our”). By using the Site or participating in our programs, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or our programs.

About Us

Believe in Santa Monica is a political committee supporting candidates and ideas for the City of Santa Monica, California. The Site is not authorized by a candidate or a committee controlled by a candidate.

Use of the Site

You may use the Site for lawful, personal, non-commercial purposes. You agree not to interfere with the Site’s operation, attempt to gain unauthorized access to it, submit false or misleading information, or use it to send spam or harmful content. The text, graphics, logos, and images on the Site belong to Believe in Santa Monica or its licensors and may not be copied or reused without permission, except for sharing or quoting our content with attribution.

Contributions

Contributions are processed securely by Anedot and are also subject to Anedot’s terms. Contributions to Believe in Santa Monica are not tax-deductible for federal or state income tax purposes. By contributing, you confirm that:

• The contribution is made from your own funds and not those of another person;
• You are not a foreign national (you are a U.S. citizen or lawful permanent resident); and
• The information you provide is true and accurate.

State and local law require us to report the name, address, occupation, and employer of contributors who give $100 or more in total, and those reports are public records. Contributions are generally non-refundable; if you believe a contribution was made in error, contact us promptly at info@believeinsantamonica.com.

Text Messaging Terms

Program description. By providing your mobile phone number and opting in, you agree to receive recurring automated informational and marketing text messages (SMS and MMS) from Believe in Santa Monica at the mobile number you provided, including messages sent using automated technology. Messages may include campaign updates, event and volunteer information, election and voting reminders, and requests for support. Donations may be solicited. All of these message types are collectively the “Program.” Consent to receive text messages is not a condition of any purchase or contribution.

Cost. Message and data rates may apply. Please contact your wireless carrier for details about your plan.

Message frequency. Message frequency varies. We may change how often we send messages, and the phone number we send them from, at any time.

How to cancel. You can opt out at any time by replying STOP to any message. You may also reply END, CANCEL, UNSUBSCRIBE, QUIT, or STOPALL. After you opt out, you will receive one final message confirming that you have been unsubscribed, and you will not receive further messages unless you opt in again. If you receive messages from more than one of our phone numbers, reply STOP to each number you no longer wish to hear from. You may also ask us to remove your number by emailing info@believeinsantamonica.com.

Help and support. For help, reply HELP to any message or email us at info@believeinsantamonica.com.

Carriers and delivery. Wireless carriers are not liable for delayed or undelivered messages. Not all mobile devices or carriers may be supported, and messages may not be deliverable in all areas.

Your number. You confirm that you are the account holder or authorized user of the mobile number you provide. If you change or deactivate that number, please reply STOP from it first or let us know so we can stop messaging it.

Privacy. We do not sell, rent, loan, trade, lease, or otherwise transfer for profit any phone numbers collected through the Program to any third party. Mobile opt-in information will not be sold or shared with third parties. For more information, see our Privacy Policy.

Email Communications

If you provide your email address, you may receive email updates from us. You can unsubscribe at any time using the link in any email we send.

Third-Party Links

The Site may link to websites and services operated by others, including our payment processor. We are not responsible for their content, terms, or privacy practices.

Disclaimers

The Site and our programs are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components, or that information on the Site is complete or current.

Limitation of Liability

To the fullest extent permitted by law, Believe in Santa Monica and its officers, volunteers, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our programs.

Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California.

Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page, and the effective date above will be updated. Continued use of the Site or our programs after changes are posted means you accept the updated Terms.
